Question: Is my drunk driving charge legal?
Question Detail: I got into a dispute and the police were called. I asked one of the officer’s for a ride home. The other officer on scene was quick to tell his partner not to give me a ride. I left the premises on foot. I then doubled back and got my car. I pulled into my driveway were the officer that denied my ride pulled in from the other end of my alley. The officer pulled into my yard behind me and said "I knew you were going to drive". This officer released me to wait at my house and give me a DUI.

It is very difficult to know if the officer’s had legal authority to initially contact you and later detain/arrest you for DUI. If the initial contact of you was for a lawful reason (if the contact for the dispute was lawful and the officer had probable cause to contact you) then it is likely the contacting officer made observations of you which may have included that you smelled of alcohol, had slurred speech, more motor coordination and so on. If such observations were made then they could have concluded that you were not in good enough condition to drive. If the officer then “saw” you actually drive a vehicle (even if it ended up on your property) then he could lawful contact you again and possibly arrest you for DUI.

However, the devil is in the details and if you must consult with a DUI defense attorney to determine if the contact of you was lawful.

A 22-year-old woman suffered a life-threatening head injury when she was hit by a car driven by an apparently intoxicated man late last night on Aurora, according to the Seattle Police Department.

According to police, the woman was crossing the street near the old Cyndy’s House of Pancakes at North 105th Street and Aurora around 11:22 p.m. Nov. 16 when a Ford Taurus traveling north slammed into her, completely demolishing its windshield.

The driver of the Taurus, who is in his 20s, showed signs of being under the influence of alcohol or drugs, according to police.

It is unclear if the woman was in a crosswalk or otherwise crossing Aurora legally, and police are continuing to investigate the accident.

Question: Can I be charged with a DUI if the car was not on?
Question Detail: I was outside my car getting something out of my trunk. The cops pulled up on me and asked for identification and I refused. They arrested me and charged me with DUI. They did not witness this vehicle in motion.

The answer is NO, you cannot be lawfully charged (actually you can be charged, but not convicted) if you were outside of your vehicle, had not control over your vehicle (keys not in the ignition) and no one saw you drive. If no one saw the vehicle move and no one saw you drive, then there “driving” element of driving under the influence cannot be proven. There is a sister offense called “physical control” and if you can dominion over your vehicle (being in the vehicle with keys) then you can charged/convicted of that offense. However, based on the facts provided you cannot be convicted of DUI or physical control.

A “first” DUI in a one state does count as a “second” DUI if the “first” DUI happened in another state. Make sense? Truth is that if the prosecutor can prove the previous DUI in another state did occur (ie. a certified copy of the final judgment) then the “new” DUI is counted as a second. However, for sentencing purposes (where penalties are enhanced) the two DUI cases must occur within a seven year period.

Question Detail: I was recently given a DUI for being present in a car in which there was alcohol present. I believe that the car was searched illegally because the driver denied the officer consent to search the vehicle and alcohol was not in plain sight. DUIs can be dismissed prior to trial if evidence gathered was done so illegal (i.e. an illegal search). You must plead not guilty and hire a qualified DUI attorney to help you. Frankly, the facts you present sound rather odd and a little vague. Whether alcohol was found in your car may not be relevant as what is relevant is whether you were driving and whether you were under the influence or your BAC was above 0.08. Best of luck.

In Washington State you would lose your driver’s license for 90 days should you lose the DOL hearing. Question: Is my wife's friend liable for the drunk driving incident?

When you get charged with a crime in this country, you have the right to your day in court. But, more often than not, you won't get that far.

According to an article in the New York Times, the vast majority of felony cases nationwide end in a plea bargain before trial begins.

"Plea bargains have been common for more than a century, but lately they have begun to put the trial system out of business in some courtrooms," wrote Richard A. Oppel Jr. "By one count, fewer than one in 40 felony cases now make it to trial, according to data from nine states that have published such records since the 1970s, when the ratio was about one in 12."

Washington state appears to be somewhere in the middle. So far this year, 26,591 criminal cases have been filed in Superior Court. Of those, 1,100, or about 1 in 26, have actually seen trial.

"The reality is that the vast majority of cases are concluded by plea bargain," said Mary Fan, an assistant professor of law at the University of Washington and a former federal prosecutor. "In many jurisdictions you may have sort of systematic procedures to offer plea bargains, almost like an assembly line."

Our judicial system is so overloaded, said Fan, that plea bargains are seen as a quick way to avoid the time and cost associated with going to trial. And in recent decades, she said, tougher sentencing laws have given prosecutors more tools to leverage a plea.

"Guilty pleas have become a powerful way of doing triage," she said. "Defense attorney often say that this comes at the expense of people making fully informed and free judgments about their fate."

While a plea deal can be a welcome break for those guilty of a crime, some say it robs those who are innocent of their chance to prove it in court.

The liquor store north of downtown Bothell has been selected to be a part of a state pilot program that will allow tastings of specific liquors and spirits, starting in September.

The tastings are allowed under a new state law. The rules are that the samples must be of “premium” liquor poured by a representative of the distiller or bottler, who has gone through Mandatory Alcohol Server Training (MAST) certification and the samples can be no more than ¼ ounce. There is also a limit of four tastings per person.

The tastings will be held on Fridays or Saturdays between 4-6 p.m. (the law restricts tastings to one time per week). The program will last for a year, then the state Liquor Control Board will decide whether to make them a permanent fixture at stores.

An exact date for the first tasting event, and what will be sampled, will be announced later. The South Hill location, located at 19111 Bothell Way NE, is the only one of Bothell’s two stores selected for the program.

Question: Can I get a DUI if I passed the breath test, but they found drugs in my system?

Question Detail: I need to know if you are pulled over and charged with a DUI however I passed all the sobriety tests and breathalyzer tests but they got a search warrant for my blood and my blood they found methamphetamine and they are trying to find me guilty for that. Is that possible even if it stays in your system for up to seventy two hours or can they prove I was under the influence at the time of the stop ?

You can certainly be arrested, charged and even convicted for a drug related DUI. However, because there is no “per se” component to drug DUI cases like there is in alcohol DUI cases (where a 0.08 or above means you’re guilty), the State/City must prove you’re impaired by the drug. This is more difficult. To prove impairment the prosecutor must show that your driving was indicative of a DUI driver, you did not perform well on field sobriety tests, and even that a drug recognition expect found that you were affected by the drug(s) in your system. In drug DUI cases you have a greater chance of prevailing by you must hire an attorney who knows what they are doing.

If your sister was charged with a DUI she must have an attorney. Despite the fact that this is her first offense she needs a lawyer to protect her rights and defend her against the charge. An attorney can hopefully find a legal defense/issue to that can be used to fight the DUI and hopefully result in fewer penalties.

SEATTLE -- The KOMO 4 Problem Solvers have discovered that tens of thousands of police dash-cam videos —potentially critical evidence— have vanished from the Seattle Police Department.
It's just one example of why KOMO News is suing the Seattle Police Department for not releasing public records that citizens are supposed to be able to see. We spent more than a year investigating the department and fighting, on the public's behalf, for access to police videos and the department's video catalogue. As part of that investigation we discovered the missing videos.
In total, more than 45,000 videos vanished from the system over three years.
"Yes, a lot of video has disappeared and there have been efforts to recover them," Whitcomb said.
There's no way of knowing if the missing dashcam videos were of someone's field sobriety test or a case like Rachner's where it was his word against the cops. And while Rachner's research shows many of the videos have been restored, more than 15,000 are still missing.
Burns Petersen, a public defender with the Associated Counsel for the Accused, said it's upsetting if there is potentially exculpatory video that is not available to defendants.
The King County Prosecutor's Office and the county's public defender agencies told us they were never notified of any large loss of video evidence.

"There is a duty and a responsibility to obtain and preserve this evidence," Petersen said.
We don't know yet if those more than 15,000 missing videos may be critical for any criminal or civil cases. However, we have developed a database for the missing videos and we're making it available so any citizen can look for themselves.

Why Fight Your Ticket?

When considering whether it is worth your effort to fight your traffic ticket you should consider the negative consequences of the ticket being on your record. This is clear and obvious. As clear as the big blue and red lights that burned deeply into your retina when you were stopped by the officer. However, you should also be aware that there is little damage that can be done by fighting your ticket. Insurance Rates

Most drivers drive faster than posted speed limits, at least occasionally. Sometimes these violations are intentional and sometimes that are purely accidental and the result of not paying attention or driving with the flow of traffic. If you have been cited for a traffic ticket you generally have three choices. The first is to grit your teeth and pay it. The second is to request the court mitigate the ticket (reduce the financial penalty). The third is to fight the ticket. And it is the third option that this book will focus almost exclusively on.

If you do decide to fight the ticket the first thing you should be aware of are the court rules and procedures. Such rules require the recipient of a traffic ticket to file the ticket and contest the charge within a certain time period following the issuance of the ticket. This information is usually on the ticket itself so be certain that you read the back of the ticket so that you can thereafter submit the ticket in a timely fashion.

The amount your insurance premium increases is dependent on several factors, including:

· Your driving record and your relationship with the insurance company. Some insurers may waive the surcharge if the customer has had a long relationship with the company and previously had a clean driving history.

· Where you live. Insurance is regulated by the states and different states have different laws regarding the cost of automobile insurance. Some states do not permit insurance companies to impose a surcharge for first-time traffic offenders, while others require insurers to raise rates for certain speeding violations.

· How much you were exceeding the speed limit. If you have been charged with speeding 25 mph above the speed limit, or charged with Reckless Driving (a criminal charge) then expect your insurance to be significantly affected. In cases such as these even a first-time citation can more than double the cost of car insurance.

In addition to the obvious insurance consequences of traffic violations (higher cost of insurance) there may be some unforeseen collateral consequences. Insurance companies may look at your driving record when determining whether you are a high-risk client and could charge you higher rates for life, health, disability or long term care insurance. Anything for a buck.

Speeding tickets are the most common, and probably most annoying, type of traffic tickets. They can also be the most expensive and most troubling to your insurance company. Defenses that do NOT Work

You must never forget that you are in a court of law and as a result, subject to the many Court rules and procedures. You must play by these rules to have a chance of prevailing. If you chose to represent yourself your adversary will be a highly trained and possibly court savvy prosecuting attorney. In front of you sitting high up on his/her thrown looking like an ordained God is the Judge.

These parties have heard most defenses and won’t fall for mere excuses and unexplained theories. Despite this, most every unrepresented defendant argues the same thing, time after time: “I didn’t do it.” In my experience, having been in traffic court for in excess of 10,000 individual traffic infractions, I can tell you with certainty that this defense does not work. Officers on DUI patrols arrested 35 drivers in Skagit County during a recent three-week period as part of the national "Drive Hammered, Get Nailed" campaign. That number is down from 60 arrests last year and 79 in 2009, according to the Washington Traffic Safety Commission.

The Anacortes and Sedro-Woolley police departments and the State Patrol participated in the campaign, from Aug. 19 to Sept. 5. The extra patrols were paid for by a grant from the Safety Commission.

Ketamine

Ketamine is a drug used in human and veterinary medicine and was developed by Dr. Craig Newlands of Wayne State University. It was then further developed by Parke-Davis (today a part of Pfizer) in 1962 as part of an effort to find a safer anesthetic alternative to phencyclidine (PCP), which was more likely to cause hallucinations, neurotoxicity and seizures. Proper protocol must be used to collect the blood sample, otherwise the blood analysis will be flawed and have no evidentiary value. The American Medical Association suggests the following procedures:

1. Hypodermic needles and syringes (must) be sterile and disposable. When reusable equipment is utilized, it should neither be cleaned with nor stored in alcohol or other volatile solvents.

2. Only a chemically cleaned, dry tube or vial with inert stopper should be used. Neither alcohol nor volatile solvents should be used to clean them. The tubes and vials should contain an anticoagulant (recommended are fluoride, citrate, oxalate and heparin), and a preservative (recommended are fluoride and mercury salt.) In the driving under the influence (DUI) context it is conceded that drugs, illegal and those prescribed by a physician, may impair perception, memory, judgment, motor skills, and the ability to operate a motor vehicle.

According to governmental statistics about one in five (18 percent) motorists killed in 2010 had drugs in their system at the time of the crash, according to data from the National Highway Traffic Safety Administration (NHTSA). http://www.whitehousedrugpolicy.gov

While this data did not distinguish whether the drugs were a factor in the accidents, nor did it indicate how many of the motorists were in fact under the influence of drugs at the time of the crash, it does raise questions about drug use by motorists.

The National Roadside Survey of Alcohol and Drug Use by Drivers, a nationally representative survey by NHTSA, found that in 2007, 16 percent of weekend nighttime drivers (roughly one in six) tested positive for legal or illegal drugs.

Question: Can I get a DUI while on prescribed medication?

Question Detail: I was stopped with no apparent reason. I was given DUI due to failed road test. I couldn't stand on one leg only due to disability, then changed to DUI when it was found I was taking prescribed medication for pain. I was not impaired or drowsy.

Unfortunately you can get a DUI while on prescription medication. However, and importantly, the prosecutor must prove that you were impaired by the drug. Impairment can be proven by your performance on the field sobriety tests, observations of you and your driving. In your case you have a disability and this immediately brings into question the FSTs. Additionally, the officer must have a lawful reason to actually stop you before proceeding with the investigation.

It is imperative you speak to a qualified Drug DUI attorney and get as much documentation you can on your prescriptions and disability.

A Seattle police sergeant who built a stellar career before an internal investigation found misconduct in his supervision of drunken-driving arrests has retired after being told the department planned to fire him.

The department hasn't released the findings of its internal investigation of Abe, a veteran of nearly 33 years who supervised officers in the unit that enforces driving-under-the-influence (DUI) laws.

One high-level source said Abe had a good record during most of his career but displayed a "marked decline in performance" tied to health problems, a family illness and unhappiness over his assignment, for a second time, to the DUI Unit last year.

Last year, Abe earned $108,034 in regular pay and $49,691 in overtime, according to city payroll records.

Abe and three officers became the subjects of internal investigations in March after an audit found dozens of DUI cases had been mishandled.

In a June 22 report, the department found that two officers in the DUI Unit routinely used a signature stamp without having a sergeant approve their arrests as required by department policy.

The third officer, John Velliquette Jr., put written statements in his reports attesting that his arrests had been approved by a sergeant even though no review had occurred, the report said.

The three officers were cleared of misconduct allegations involving honesty and arrest procedures after the OPA heard testimony that the practice preapproving arrests had been going on for 20 to 25 years. Most area law-enforcement agencies do not require DUI arrest screening because suspects are generally released after processing, the OPA noted.

Although the allegations were not upheld, the three officers were ordered to undergo supervisory counseling and training for violating department policy.

Abe also "wasn't happy" when he was assigned to the DUI Unit in March 2010, Velliquette said, characterizing Abe's supervision as "not much."

Asked if Abe had screened arrests in person, Velliquette stated "not that I recall" and related that, in his opinion, supervision of the DUI officers had been lacking.

His statements were used by defense attorneys in another case, who sought dismissal of a DUI charge against their client or suppression of Velliquette's testimony.

A Seattle Municipal Court judge declined the requests Sept. 1 but said Velliquette could be cross-examined by the defense about his false statement that a sergeant had approved the arrest.

Question: Will a DUI affect my college applications?
Question Detail: I am trying to apply for graduate school. I got a DUI recently and I am really worried that it will affect my chances of getting accepted somewhere. What can I do?

It is hard to know if a DUI will affect your ability to be accepted by the college. Some colleges may be very strict with their applicants and some less so. I do believe that they key is honesty and full disclosure. It is more important to be honest on an application than dishonest – as dishonesty will surely result in troubles.

Question: What happens if I accidentally missed a court date for a DUI?
Question Detail: I had my first DUI and I went to the first two court dates, and they were months apart. Now I have accidentally missed this last calendar call and will get into big trouble. I don't want them to come to my house and arrest me.

If you missed your court date – do not panic! You have no history of failing to appear for court so what you should do is talk to an attorney who is familiar with the court you are in. An attorney should immediately be able to clarify what you must do to rectify the situation in your specific court. However, you generally have three options (depending on the court): 1) Go to the court and pay a small fee, quash the warrant and get a new court date; 2) Get a court date (or in some courts, appear at the clerk’s desk and they’ll put your file in court in front of the judge), tell the Judge why you missed court, you’re sorry, and you wish to “quash the bench warrant;” and 3) Turn yourself into jail and appear at the next available court date from jail. Number three is not preferred. I highly advise you talk to a local lawyer.

Question: Can I fight my DUI if the breathlyzer machine wasn’t working?
Question Detail: Arresting officer couldn't get the machine working and even said I hope I can get this working. I know that the Intoxilyzer 5000 was used. I've heard that this machine has some faults and in my case it did. They couldn't get it working for a couple of minutes. Could this give me a reasonable cause to fight this DUI? Could the calibration of the machine have been wrong?

You can and must fight your DUI if the machine wasn’t working. However, the question that we do not know is, was the machine having problems (ie. faults that can be argued) or was the operator having problems? Either way, it is an issue worth investigating and your attorney should pursue this defense.

On August 12, 2011 at approximately 1:02 a.m., 9700 block N.E. 132nd St. in Kirkland, a Kirkland police officer stopped a 58-year-old Kirkland man after the Kirkland Police officer observed poor lane travel. The Kirkland man performed poorly on field sobriety tests and provided a preliminary breath test of .136 and a blood alcohol content sample of .118. On August 25^th at approximately 3 a.m. at the 900 block of Sixth St. in Kirkland, a 26-year-old King County man was driving north bound on Sixth Street in Kirkland and struck a parked vehicle. The man then called to have his vehicle towed from the scene. A towing representative called police about this matter. Kirkland Police stopped the man while he was walking back to his vehicle and admitted to driving the vehicle, but missed the part about hitting another vehicle. He failed all field sobriety tests and was arrested for driving under the influence of alcohol.

Extra law enforcement officers will be watching for drunken drivers today till Sept. 5, during the annual Drive Hammered, Get Nailed campaign. According to a new law, DUI suspects will always have their car impounded.

The Skagit County Sheriff's Office, State Patrol, and city and Swinomish Tribal Police departments will participate in the emphasis patrols, organized and supported by the Skagit County Traffic Safety Task Force.

A new law called "Hailey's Law" went into effect July 22 to prevent drunken drivers from getting back into their cars. Now all DUI arrestees' cars will be towed and impounded for at least 12 hours.

Only a registered or legal owner who was not in the car at the time of arrest is allowed to get the car out of impound before the mandatory 12 hours.
