LYNNWOOD - Lynnwood City Councilman Jim Smith has been cited for drunken driving.
Smith, 48, was stopped by Lynnwood police early Friday morning after failing to stop at an intersection. Smith failed several sobriety tests and the officer smelled alcohol on Smith's breath, the police report said.
A Breathalyzer test listed Smith's blood-alcohol level at .13 percent, police said. People with blood-alcohol levels of .08 percent and above are considered legally intoxicated.
Smith was released after several hours in police custody. A hearing for his case has not been scheduled. A drunken-driving charge carries a maximum penalty of one year in jail and a $5,000 fine.
